Letter of invitation and its non-compliance
• Travel to Spain with a letter of invitation
• Failure to comply with the Letter of Invitation
What happens if we come to Spain with a letter of invitation and do not return to our home country? Will I be irregular? And what happens to the person who invited me?
These are some of the questions we receive at HAC LEGAL Consultoria Integral, often both through our phone advisory and our social networks.
TRAVEL TO SPAIN WITH A LETTER OF INVITATION
To travel to Spain, whether with a tourist visa or without a visa, we will need to prove that you have met a number of entry requirements, including accommodation.
To show where we will be staying during our stay in Spain we often resort to a letter of invitation. That is, the one that makes us a friend or family member who lives in Spain and invites us to stay at their home during our visit.
This letter of invitation will serve us during the period that we have decided to stay in Spain, always for a period of less than 90 days, to prove where we will stay.
It is therefore a temporary document that will not allow us to stay in Spain and that cannot exceed 90 days.
What happens if there is a BREACH OF THE INVITATION LETTER? What happens if someone comes with an invitation letter and stays more than 90 days in Spain?
We remind you that the maximum time that a foreigner can stay in Spain as a tourist and, therefore, without having a residence permit, is 90 days. Therefore,
1. the first consequence of not returning to the country of origin is that the alien will become in an irregular situation in our country. This means that he could be subject to a sanction, either a financial sanction or an expulsion order, with a consequent ban on entry.
2. the letter of invitation implies a commitment to return to the country of origin, which would be breached by not returning and staying in Spain.
3. The guest, as such, will have to ensure that the guest returns to the country of origin at the end of the intended period of stay. Therefore, if the foreigner decides to stay in Spain, this decision may also have serious consequences for the invitee, if this commitment to return is not fulfilled, which may lead to important financial penalties as it is a serious violation of the law on foreigners.
In this case, fines can be as high as 500 or 600 euros, which is the usual amount, but fines could be as high as 100,000 euros if they consider the offence committed to be very serious.
